San Jose Divorce Lawyer

A divorce can be simple or complicated. It can be uncontested or bitterly contested.

If you are considering filing for divorce, or if your spouse has already filed, you should talk to a family law attorney as soon as possible.

At the Dominion Law Group, we are experienced family law and divorce attorneys. When we talk about your situation, we will listen carefully to the circumstances you are in, your goals, and your hopes for the future.

Then we will explain the divorce process and how we may be able to achieve your goals.

Divorce In California

A divorce or legal separation case is initiated in California by one of the two parties filing a petition with family court. The other party then has 30 days to respond. While it does not matter to the court which party files for divorce, there may be reasons why you would want to file quickly. Once you have served the other party with your divorce petition, both sides are automatically barred from disposing of, misusing, or hiding assets.

In California, it takes at least six months to get a divorce, although some cases take longer. Before the case is tried in family court, both sides will try to reach an agreement on issues such as:

Property division

Child custody and visitation

Child support

Spousal support

Some divorces turn nasty quickly, because one party (and their attorney) thinks it is going to give them an advantage. For example, it is not unusual for one party to make accusations of domestic violence against the other party to gain the upper hand in child custody negotiations. Those accusations, as well as other aggressive tactics, need to be dealt with promptly or you could be greatly harmed.

The Dominion Law Group will fight those battles for you if necessary. But we try to avoid those types of conflicts if we can. Whenever possible, we use the collaborative law approach to help you end the conflict and reach a resolution.

Whenever possible, we work to achieve a speedy resolution of matters surrounding the dissolution of a marriage. This can reduce legal costs, result in a less stressful process, and lessen harmful emotional effects felt by the children in the marriage.
