Establishing and Modifying Spousal Support
The San Jose alimony lawyers at the Dominion Law Group represent clients in all aspects of spousal support, including negotiation, litigation, and modifications to spousal support.
Spousal support (also known as alimony or spousal maintenance) is not always a part of a divorce stipulation. In divorces in which the agreement was negotiated by the parties' attorneys, the issue of spousal support is one of many issues to be negotiated as part of the overall settlement. In litigation, the issue of spousal support is determined by the judge.
Will I Have to Pay Alimony?
In determining whether one of the parties is required to pay spousal support, and how much, the judge will consider such factors as:
- How long the couple has been married
- The income each spouse can earn independently
- The standard of living established during the marriage
- The financial need of the less-moneyed spouse
- Ability of supporting spouse to pay alimony
- Age and health of both parties
- Other factors
Temporary spousal support may also be ordered while the divorce is in process.
Spousal support does not last forever. At some point parties receiving support are expected to support themselves. The judge will determine the duration of support based on the amount of training and education the recipient requires in order to support herself or himself.
At the Dominion Law Group, our San Jose alimony lawyers are experienced negotiators and litigators. Whatever your situation, we will represent you assertively. In matters involving spousal support, we always work to protect the rights and interests of the client.
